1.) Scope/Validity

These terms and conditions apply to the use of the website/online-shop: www.sportandmore.nl of Bruins Holding BV and thus for all offers, invoices and for all agreements between Bruins Holding BV and the customer, regarding to the website/online-shop provided by Bruins Holding BV: sportandmore.nl

The applicability of the general terms and conditions of the customer is expressly rejected, unless otherwise agreed.

 

2.) Final agreement

The product descriptions displayed on the seller’s website/online-shop do not represent a binding offer by the seller. Product descriptions are only intended to invite the customer to a binding offer.

To conclude a binding offer for a purchase agreement, first the customer has to place the selected goods in the virtual shopping cart and he has to go through the digital order process. Then he has to click on »buy now« to agree to buy the goods in his virtual shopping cart. Therefor it is also important that the customer accepts the terms and conditions and puts a checkmark next to »read and accepted« at the corresponding position.

The seller can then accept the order within 3 days and sends the customer (via email) an order confirmation.

If the seller does not accept the order of the customer within the set period, this is considered a rejection of the order, so that the customer is no longer bound by his declaration of intent.

If an offer is made through the seller’s online order form, the contract content will be retained by the seller. After submitting an order, all related data will also be archived on the seller’s website. If the customer has created a customer account in the seller’s online shop before submitting his order, the customer can open his password-protected customer account for free via the corresponding login data.

The customer must ensure that the e-mail address provided by him is correct so that the messages sent by the seller to this e-mail address can be received. In particular, the customer must ensure that SPAM filters do not block the messages sent by the seller.

Customers have a 14 days right of withdrawal.

 

3.) Prices

The prices quoted by the seller are total prices and include VAT. Any delivery or shipping costs will be shown separately.

 

4.) Terms of payment and payment options

The customer has different payment options. These are stated on the website/online-shop of the seller and are as follows:

  • iDEAL (for Dutch account holders)
  • MrCash/Bancontact (for Belgian account holders)
  • Sofortüberweisung (for German account holders)
  • Visa and Mastercard (Credit Card)
  • PayPal
  • Afterpay
  • Paydirectly
  • Prepayment (by means of a normal bank transfer)

 

The payment options iDEAL, Visa, Mastercard, MrCash/Bancontact, PayPal and Afterpay are part of the renewed Rabo OmniKassa/Rabo OnlineKassa, which supports the main Dutch and foreign payment methods.

 

  • iDEAL:

Payment with iDEAL is only possible if you have a Dutch bank account.

  • Prepayment:

If the customer chooses for prepayment, the amount is payable immediately after conclusion of the contract. (Please do not forget to specify a payment reference, for example the order number.)

Once the payment has been credited to the seller’s account, the customer’s order will be shipped.

5.) Delivery and shipping conditions

The delivery will be made to the delivery address specified by the customer/the delivery address specified in the order.

If the shipping company returns the goods to the seller because delivery to the customer was not possible, the customer will bear the cost of the failed delivery. This does not apply if the customer has not received the delivery on time, unless the seller has announced the (later) delivery within a reasonable time.

 

6.) Liability

In general, the statutory provisions on liability for defects and in particular the following provisions apply: Bruins Holding BV is not liable for the incorrect or improper use of ordered products. If available, the customer must first read the instructions for use before using a product. If a description or instruction for a product is not clear or unavailable, the customer may contact Bruins Holding BV.

If liability arises for Bruins Holding BV, the highest amount for which liability can be claimed is the amount of the purchase price of the product in question.

Bruins Holding BV is not liable for deviations in prices, product photos and texts. The customer must notify the seller of the damage of a purchased product within two weeks of discovery of the damage. The limitation period for notice of defects is two years from notification of the defect.

Bruins Holding BV reserves the right to unilaterally change these terms and conditions at any time.

 

7.) Competent court and applicable law

Agreements between Bruins Holding BV and the customer are governed by Dutch law. Any dispute arising out of the contract or these terms and conditions shall be settled by the competent judge in Arnhem. Should individual provisions be ineffective or contain errors, the remaining provisions remain unaffected. Ineffective or incorrect provisions are replaced by provisions with an active content that comes closest to the meaning of the inactive content.

 

Only the Dutch text of these terms and conditions is binding. Should any provision of these terms and conditions be ineffective or void, the remaining provisions remain in full.
